Terms of Service

By creating an account, joining the waitlist, or otherwise using the Services, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 18 years old and capable of entering into a binding contract under Section 11 of the Indian Contract Act, 1872. If you are using the Services on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.

Zygo Leads is a lead management product for real estate professionals. It helps you capture enquiries from WhatsApp, web forms, ads, and referrals, qualify buyers and sellers, send automated follow-ups, and manage your pipeline. Some features may be marked "beta", "preview", or "coming soon" and may change without notice.

• You must provide accurate and current information when you register.
• You are responsible for keeping your password and OTPs confidential.
• You are responsible for all activity that occurs under your account.
• Tell us promptly at support@zygoleads.com if you suspect unauthorised access.

You agree not to:

• use the Services for any unlawful, fraudulent, or harmful purpose;
• upload viruses, malware, or other harmful code;
• send unsolicited commercial messages in violation of the Telecom Commercial Communications Customer Preference Regulations, 2018 or the WhatsApp Business Messaging Policy;
• scrape, reverse-engineer, decompile, or otherwise misuse the Services or their underlying code;
• attempt to gain unauthorised access to any part of the Services or other users' accounts;
• upload content that infringes any third party's intellectual property or privacy rights;
• publish content that is unlawful under Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, including content that is defamatory, obscene, harassing, or harmful to minors.

You are responsible for ensuring that you have a lawful basis to process the personal data of your leads, including any consent required under the DPDPA.

• Subscription fees, the free first month for early users, and applicable plans are described on our website at the time of purchase. We may change our prices on prospective notice.
• Payments are processed by Razorpay or another licensed payment aggregator. Goods and Services Tax (GST) and any other applicable taxes will be added to the price shown.
• Subscriptions renew automatically until cancelled. You can cancel from the in-app settings; cancellation takes effect at the end of the current billing period.
• Refunds are governed by our refund policy displayed at the time of purchase and by the Consumer Protection (E-Commerce) Rules, 2020.

The Services, including all software, design, logos, text, graphics, and trademarks, are owned by Zygo Leads or our licensors and are protected by the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your internal business purposes during the term of your subscription.

You retain ownership of the data, files, and messages you upload or generate using the Services ("Your Content"). You grant us a limited licence to host, store, transmit, and process Your Content solely as needed to provide the Services. You are solely responsible for the legality and accuracy of Your Content.

The Services rely on third-party platforms, including the WhatsApp Business Platform, Supabase, Razorpay, and Google or Apple push notification services. Your use of these is also subject to their respective terms. We are not responsible for outages or changes to third-party platforms that may affect the Services.

The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Zygo Leads's aggregate liability arising out of or in connection with the Services, whether in contract, tort (including negligence), or otherwise, will not exceed the total fees paid by you to us in the twelve (12) months preceding the event giving rise to the claim, or ₹10,000, whichever is higher. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, or data. Nothing in these Terms limits any liability that cannot be limited under applicable law (for example, liability for gross negligence or fraud).

You agree to indemnify and hold harmless Zygo Leads, its officers, employees, and affiliates from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.

We may suspend or terminate your access to the Services at any time for any breach of these Terms, for non-payment, or for activity that we believe poses a security, legal, or reputational risk. You may terminate your account at any time from in-app settings. Sections intended to survive termination (for example, intellectual property, limitation of liability, indemnification, and governing law) will remain in effect.

These Terms are governed by the laws of India. The parties will first try to resolve any dispute amicably. If a dispute remains unresolved for 30 days, it will be referred to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration will be conducted by a sole arbitrator mutually appointed by the parties, in English, with its seat and venue at Mohali, Punjab. Subject to arbitration, the courts at Mohali, Punjab will have exclusive jurisdiction.

We may change these Terms from time to time. The updated Terms will be posted on this page with a new "Last updated" date. Material changes will be communicated to you by email or in-app notice at least 7 days before they take effect. Continued use of the Services after the effective date means you accept the changes.
